Hamilton Island Enterprises - Underpayment of Employees 

In late 2020, Hamilton Island Enterprises (HIE) undertook a comprehensive review of its practices relating to how it remunerates employees.

The review commenced after HIE was notified of potential concerns about the remuneration arrangements for some employees by employees and the Fair Work Ombudsman.

The review assessed the period from 19 December 2014 to 18 December 2022 and found that some current and former employees covered by modern awards and employed under annual salary arrangements may not have been paid sufficiently to cover all their hours of work. In certain cases, this resulted in employees not being paid their full entitlements.

Since conducting the review, HIE’s priority has been to ensure that all current and former employees who were underpaid receive their full entitlements as soon as possible, and we are continuing to fully cooperate with the Fair Work Ombudsman.

HIE has now implemented a range of best practice processes and systems, including new time and attendance systems, to help to ensure ongoing compliance.

HIE takes its legal obligations extremely seriously. We fully acknowledge employee underpayments are not in keeping with the values we hold ourselves personally and professionally accountable to. We unreservedly apologise and would like to assure all employees that this matter is the top priority for our business.
 
We have been working constructively with the Fair Work Ombudsman (FWO) to ensure that employees and former employees are paid what they are owed. As part of this process, it was announced that we have agreed an enforceable undertaking with the Fair Work Ombudsman (FWO) in relation to the historical underpayment of employees.
 
The FWO’s enforceable undertaking requires us to finalise the rectification of underpayments by 30 June 2025, and commit to undertake a number of activities to ensure our ongoing compliance with workplace laws, including conducting an independent audit, and workplace relations training for managers and human resources personnel.

A: We have completed the vast majority of final payments and will progressively continue to pay those that are outstanding. We are attending to finalising the final reconciliation as a matter of priority. We have committed to the FWO that all repayments will be made, at the latest, by 30 June 2025.

A: The final reconciliation covers the period from 19 December 2014 to 18 December 2022 (or 22 October 2024 for some vehicle workshop employees).
